South Africa’s (SA) National Council of Provinces has approved the Immigration Amendment Bill, signalling a major step in aligning the country’s immigration laws with Constitutional Court rulings.

 

The bill, which updates the 2002 Immigration Act, revises how undocumented foreigners can be arrested and detained for deportation, ensuring that enforcement procedures respect constitutional rights.

 

Chairperson Jane Mananiso said the legislation aims to restore constitutional balance, reflecting both judicial guidance and the government’s response to concerns about illegal immigration.

 

The approval comes as SA faces a heated public debate on migration, with discussions focused on access to education and healthcare for non-citizens, the treatment of undocumented migrants, and the country’s broader immigration strategy.

 

Supporters of the amendments argue they provide clarity and strengthen legal protections, while critics caution that enforcement must be fair and carefully monitored.

 

The bill will now continue through Parliament before it can be enacted into law.
