The DA argues that the Electoral Commission of SA (IEC) deadlines must apply equally to all political parties contesting elections.
Political parties were required to submit candidate lists by 17:00 on August 28. The DA says candidates were submitted in all 257 municipalities before the deadline.
The party argues that entering candidate information into the IEC’s electronic system does not constitute formal submission, as parties were required to complete a final submission process.
The DA said the ANC should not receive special treatment after failing to meet a deadline that applied to all parties.
The party has also referred to previous court decisions that required strict adherence to electoral deadlines, arguing that consistent application of the rules is necessary to protect free and fair elections.
The Electoral Court application comes as the ANC seeks to overcome the consequences of missing the candidate-list submission deadline in six municipalities.
The DA maintains that allowing late submissions would undermine the principle of equal treatment among political parties and could affect the integrity of the electoral process.
