Reasonable apprehension of bias not enough for SA MP recusal

This, as the question of possible conflict of interest was raised about members who have opened criminal cases against witnesses appearing before the committee. The committee was established to investigate allegations of criminal infiltration, corruption and political interference in the justice system. The KwaZulu-Natal Police Commissioner Nhlanhla Mkhwanazi made the allegations.

Member of Parliament (MP), Lisa Schickerling has opened a case against placing Police Minister Senzo Mchunu on a leave of absence, while MK Party MP, David Skosana has opened cases against Mchunu and the suspended Deputy National Commissioner Shadrack Sibiya. Parliament’s legal advisor, Andile Tetyana, gave the committee direction on the matter.

“We must point out, affected members not decision makers, committee makes decision, no reason for affected members to withdraw from the inquiry,” he said.
