South Africa’s (SA) Democratic Alliance (DA) has formally mounted a court challenge against the controversial Expropriation Act, bringing its policy clash with coalition partner the African National Congress (ANC) to the Western Cape High Court.
The law, which permits state land expropriation under specific public interest conditions, has drawn international scrutiny and sharp rebukes from United States political figures, including President Donald Trump, over property rights concerns.
The DA is asking the court to strike down the legislation as unconstitutional, citing procedural flaws during its passage through Parliament and arguing that its provisions leave private property vulnerable to unchecked state takeover. The ANC continues to defend the law as a critical instrument for equitable land reform.
