The fuel levy matter between South Africa’s (SA) opposition party Economic Freedom Fighters (EFF) and Finance Minister Enoch Godongwana is currently underway in the Western Cape High Court.
The EFF is challenging Godongwane’s powers to change the fuel levy.
The party stated that only Parliament should have the authority to make changes.
The matter is being heard by Judge Mark Sher, who made a clear distinction that this case is about the fuel levy, and not the actual cost of fuel.
At the end of March Godongwana announced a temporary reduction on the fuel levy which was later extended to May.
The EFF says if the relief is only temporary, consumers will bear the brunt of future increases.
The party is arguing that only Parliament had the constitutional power to impose or amend taxes.
The matter carries broader implications for National Treasury.
