Former South African (SA) Justice Minister Penuell Maduna told the Truth and Reconciliation Commission (TRC) cases Inquiry in Johannesburg that post-TRC amnesty discussions between the democratic state and former SA Defence Force (SADF) generals collapsed over full disclosure demands.
Under cross-examination by legal representatives for victims’ families, Maduna, who served as Justice Minister from June 1999 to April 2004, confirmed details surrounding a key February 2003 meeting. The meeting included Maduna, former Safety and Security Minister Charles Nqakula, and a delegation of SADF generals led by former Deputy Chief Dirk Marais.
Maduna validated statements made by Marais in a 2019 interview, confirming that negotiations regarding proposed post-TRC amnesty legislation failed because the apartheid-era military leadership demanded blanket amnesty without full disclosure of gross human rights abuses.
