This follows allegations of sexual harassment that his secretary Andiswa Mango had made against him. The tribunal found that Mbenenge initiated the flirtatious relationship. It has ruled that his actions do not amount to gross misconduct. The final decision now rests with the Judicial Service Commission, which can uphold, or upgrade that sanction. Advocacy group, Judges Matter Director, Allison Tilley explains what the finding mean
“Obviously assuming that the decision is not appealed- as it stands, it means that because he’s guilty of a degree of misconduct, but which doesn’t amount to gross misconduct- it therefore doesn’t rise to the level of impeachment, and the sanction will be less than that. We don’t know what the sanction is at this stage, that will be determined later on in the process,” she said.
