Canady told <\/span><em><span data-preserver-spaces=\"true\">Reuters<\/span><\/em><span data-preserver-spaces=\"true\">. &#8220;We just have to hang on and navigate our way through this so we don&#8217;t all go broke in the short run.&#8221;<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">It is a dilemma that is sinking in <\/span><span data-preserver-spaces=\"true\">with<\/span><span data-preserver-spaces=\"true\"> companies, foreign trade ministries, trade lawyers and economists as the US Supreme Court considers the legality of Trump&#8217;s global tariffs, with arguments set for Wednesday.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">Under one legal authority or another, Trump&#8217;s tariffs are expected to stay in place long term.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">The court, whose 6-3 conservative majority has backed Trump in a series of major decisions this year, is hearing his administration&#8217;s appeal after lower courts ruled that the Republican president overstepped his authority in imposing sweeping tariffs under a federal law meant for emergencies.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">A ruling striking down Trump&#8217;s use of the 1977 International Emergency Economic Powers Act (IEEPA) to quickly impose broad global tariffs also would eliminate a favourite cudgel to punish countries that draw his ire on non-trade political matters. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">These have ranged from Brazil&#8217;s prosecution of former President Jair Bolsonaro to India&#8217;s purchases of Russian oil that help fund Russia&#8217;s war in Ukraine.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">&#8220;For decades, our country has been looted, pillaged, raped and plundered by nations near and far, both friend and foe alike,&#8221; Trump said in announcing sweeping reciprocal tariffs in April under this law.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">&#8220;Reciprocal, that means they do to us and we do it to them,&#8221; Trump added.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">Trump is the first President to invoke this statute, which <\/span><span data-preserver-spaces=\"true\">often<\/span><span data-preserver-spaces=\"true\"> has<\/span><span data-preserver-spaces=\"true\"> been used to <\/span><span data-preserver-spaces=\"true\">apply<\/span><span data-preserver-spaces=\"true\"> punitive economic sanctions <\/span><span data-preserver-spaces=\"true\">to<\/span><span data-preserver-spaces=\"true\"> adversaries, to impose tariffs.<\/span> <span data-preserver-spaces=\"true\">The law provides<\/span><span data-preserver-spaces=\"true\"> the <\/span><span data-preserver-spaces=\"true\">President <\/span><span data-preserver-spaces=\"true\">broad<\/span><span data-preserver-spaces=\"true\"> authority to regulate a variety of <\/span><span data-preserver-spaces=\"true\">economic<\/span><span data-preserver-spaces=\"true\"> transactions <\/span><span data-preserver-spaces=\"true\">when<\/span><span data-preserver-spaces=\"true\"> a national emergency <\/span><span data-preserver-spaces=\"true\">is declared<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">In this case, Trump deemed a $1.2 trillion US goods trade deficit in 2024 a national emergency, even though the US has run trade deficits every year since 1975, and also cited overdoses of the often-abused painkiller fentanyl.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">US Treasury Secretary Scott Bessent said he expects the Supreme Court to uphold the IEEPA-based tariffs. <\/span><span data-preserver-spaces=\"true\">But if it strikes down the tariffs, Bessent said in an interview, the administration will <\/span><span data-preserver-spaces=\"true\">simply<\/span><span data-preserver-spaces=\"true\"> switch to other tariff authorities, including Section 122 of the Trade Act of 1974, which allows broad 15% tariffs for 150 days to calm trade imbalances.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">Bessent said Trump also can invoke Section 338 of the Tariff Act of 1930, a statute that allows tariffs up to 50% on countries that discriminate against US commerce.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">&#8220;You should assume that they&#8217;re here to stay,&#8221; Bessent said of Trump&#8217;s tariffs.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">For countries that have negotiated tariff-lowering trade deals with Trump, &#8220;you should honour your agreement,&#8221;
