Malema was found guilty last year of unlawful possession of a firearm and discharging a firearm in a public place, among other offences. The charges stem from an incident during the EFF\u2019s fifth anniversary celebrations at Sisa Dukashe Stadium in Mdantsane in July 2018, which was captured on video footage widely circulated at the time.<\/p>\n

The state has asked the court to impose a sentence of 15 years\u2019 imprisonment, arguing that the offence involved the dangerous use of a firearm in a crowded public space and warranted a harsh penalty to serve as a deterrent.<\/p>\n

Malema has consistently denied wrongdoing and has indicated he will challenge any custodial sentence through the courts. Speaking ahead of sentencing, he said he is prepared to immediately launch an appeal should the magistrate rule against him.<\/p>\n

\u201cIf they send me to prison, I will appeal immediately,\u201d Malema said. \u201cI will have a legal team in Bhisho and another in East London on the same day. Once the sentence is handed down, we will apply for leave to appeal, and if that is refused, we will petition the High Court.\u201d<\/p>\n

Malema has framed the case as politically motivated and previously told supporters he would pursue the matter to the highest court in the country if necessary.<\/p>\n
