South Africa\u2019s (SA) newly established parliamentary Impeachment Committee will continue its preparatory operations this week despite an urgent court bid by President Cyril Ramaphosa to bring the process to a dead stop.<\/p>\n

The Western Cape High Court in SA heard two days of intense legal arguments regarding Ramaphosa’s request for an urgent interdict. Ramaphosa wants all parliamentary proceedings suspended until the courts rule on his separate application in September to completely throw out the Section 89 Independent Panel report. That initial report found a prima facie case against him concerning the Phala Phala farm scandal, where large sums of undeclared foreign currency were stolen from his private property.<\/p>\n

Impeachment Committee Chairperson Makashule Gana confirmed that the committee will proceed with its scheduled meeting on Wednesday. Gana noted that Ramaphosa’s own legal team acknowledged that the committee’s current work, which includes finalising terms of reference, preparing witnesses, and appointing evidence leaders, is preparatory and not yet the subject of the interdict.<\/p>\n

“We’re not going to stop until the court has made a determination,” Gana stated, reiterating that the committee is bound to carry out its constitutional mandate unless explicitly ordered otherwise by a judge.<\/p>\n

The political stakes remain exceptionally high in the country. Opposition parties, including opposition uMkhonto weSizwe Party and the African Transformation Movement, have legally opposed Ramaphosa’s application. They argue that the High Court lacks the authority to pause an inquiry that was essentially mandated by a May Constitutional Court ruling, which declared Parliament\u2019s previous dismissal of the Phala Phala report irrational.<\/p>\n

The full bench of the Western Cape High Court is expected to deliver its judgment on whether to pause the inquiry by the end of next week.<\/p>\n
