{"id":47576,"date":"2026-10-08T13:20:07","date_gmt":"2026-10-08T11:20:07","guid":{"rendered":"https:\/\/www.channelafrica.co.za\/channelafrica\/?post_type=news&#038;p=47576"},"modified":"2026-10-08T13:20:07","modified_gmt":"2026-10-08T11:20:07","slug":"concourt-judgment-does-not-legalise-unlawful-migration-sa-minister","status":"publish","type":"news","link":"https:\/\/www.channelafrica.co.za\/channelafrica\/news\/concourt-judgment-does-not-legalise-unlawful-migration-sa-minister\/","title":{"rendered":"ConCourt judgment does not legalise unlawful migration: SA Minister"},"content":{"rendered":"<div class=\"x_elementToProof\" dir=\"ltr\">The Chairperson of the Inter-Ministerial Committee (IMC) on Migration in South Africa (SA), Minister Mmamoloko Kubayi, has sought to clarify the Constitutional Court judgment on asylum seekers.<\/div>\n<div class=\"x_elementToProof\" dir=\"ltr\"><\/div>\n<div class=\"x_elementToProof\">This comes as protests erupted in parts of the country after the Department of Home Affairs effectively reopened SA\u2019s asylum system to new applicants.<\/div>\n<div class=\"x_elementToProof\" dir=\"ltr\"><\/div>\n<div class=\"x_elementToProof\">Kubayi has been addressing the media following Thursday night\u2019s urgent meeting by IMC members.<\/div>\n<div class=\"x_elementToProof\" dir=\"ltr\"><\/div>\n<div class=\"x_elementToProof\">\u201cThe judgment does not grant refugee status or permanent residence automatically to anyone who enters South Africa, nor does it legalise unlawful migration. It simply requires that individuals claiming asylum be allowed access to the asylum determination process.\u201d<\/div>\n<div class=\"x_elementToProof\" dir=\"ltr\"><\/div>\n<div>\u201cSo that their claims can be properly assessed in terms of the law.
